The provisions of this section shall not be con strued to include what are known as the “Militia Warrants” of ‘ the Territory. SEO. 8. At the end of each fiscal year, and after any appropriation or expenditure which may be required to be paid out of any particular fund shall have been paid, all the surplus which shall remain in any or either one of the particular funds shall be used, first, in paying any deficit in any other fund, and if not needed for that purpose to be used in paying off outstanding warrants except warrants “issued or purporting to be issued under and by virtue of an act” entitled “An Act to amend an act entitled ‘Militia, ‘ approved January 28. 1867, and others” known as militia warrants, such warrants to be paid in the order of their issue until all of the outstanding warrants of this Territory, with the exception off what are known as militia warrants, shall be paid; the Treasurer shall transfer all surplus after paying warrants as provided above to the penitentiary sinking fund for the payment and redemption of penitentiary bonds. SEO. 9. That section 191 of the Compiled Laws of 1884 be and the same is hereby amended so as to read as follows: Section 101. Between the 15th and 20th of November in each year it shall be the duty of the Treasurer, in the same manner, to present all the warrants, coupons and other evidences of indebtedness that may have been paid after the date that the last were burned, and the same proceedings shall be practiced as before ordained, and the lists of the warrants, coupons and other evidenced of indebtedness destroyed shall have the same effect as expressed in section 190. ‘ SEO. 10.
